Terms of Service

These Terms govern your access to and use of MotionHub.studio (“MotionHub”, “Service”), operated by Fexillon. By creating an account or otherwise using the Service you agree to these Terms. If you are using MotionHub on behalf of a business, you represent that you are authorised to bind that business to these Terms.

1. Who can use MotionHub

You must be at least 18 years old, or the age of majority in your jurisdiction, to create a studio account. Customer accounts may be opened for minors by their parent or legal guardian. You must provide accurate information and keep it up to date.

2. Roles

Studios are responsible for the conduct of their staff and for the accuracy of the information they publish about their business, classes, and pricing.

4. Customer payments

When a customer pays for a class, package, or membership, the payment is processed by the studio’s chosen payment provider (Stripe, MercadoPago, PayPal, or similar). MotionHub does not store full card details. Refunds, chargebacks, and billing disputes for customer transactions are between the customer and the studio; MotionHub may assist but is not a party to those payments.

6. Your content

You retain ownership of the content you upload (logos, class descriptions, photos, documents, etc.). You grant MotionHub a worldwide, royalty-free licence to host, display, and process that content solely as needed to operate the Service for you. You are responsible for making sure you have the right to upload everything you post, and that it does not violate any third-party rights or applicable law.

7. AI assistant connections (MCP)

MotionHub can be connected to third-party AI assistants (Claude, ChatGPT, and similar) through our Model Context Protocol (MCP) integration. When you connect an assistant:

We work to keep the Service available, but we do not guarantee uninterrupted operation. Planned maintenance, third-party outages, and unforeseen incidents may affect availability. We are not liable for losses arising from downtime, but we will tell you about planned maintenance in advance where possible.

9. Termination

You may stop using the Service at any time and close your account from the admin panel. We may suspend or terminate your access if you breach these Terms, if your account is required to be terminated by law, or if your account is inactive for an extended period. On termination, you remain liable for any fees already owed.

10. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

11. Limitation of liability

To the maximum extent permitted by law, MotionHub will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability for any claim arising out of or relating to the Service is limited to the fees you paid us in the twelve months preceding the event giving rise to the claim.

12. Indemnity

You agree to defend, indemnify, and hold MotionHub harmless from any claim, demand, or expense (including reasonable legal fees) arising out of your use of the Service, your content, or your violation of these Terms.

13. Changes to the Service or these Terms

We may modify the Service or these Terms from time to time. If a change is material, we will give at least 30 days’ notice by email or in-app banner. Continued use of the Service after the change takes effect constitutes acceptance of the new Terms. If you do not agree, you may stop using the Service.

14. Governing law

These Terms are governed by the laws of the jurisdiction in which Fexillon is established, without regard to its conflict-of-laws provisions. Disputes will be resolved in the competent courts of that jurisdiction, except where mandatory consumer-protection law gives you a different right.
