Terms of Service
Effective date: May 26, 2026
These Terms govern your access to and use of MotionHub.studio (“MotionHub”, “Service”), operated by Fexillon. By creating an account or otherwise using the Service you agree to these Terms. If you are using MotionHub on behalf of a business, you represent that you are authorised to bind that business to these Terms.
1. Who can use MotionHub
You must be at least 18 years old, or the age of majority in your jurisdiction, to create a studio account. Customer accounts may be opened for minors by their parent or legal guardian. You must provide accurate information and keep it up to date.
2. Roles
- Studio account: gives the studio owner, managers, and instructors tools to schedule classes, sell memberships, take payments, manage attendance, and communicate with customers.
- Customer account: lets students of a studio book classes, manage memberships, and communicate with their studio.
Studios are responsible for the conduct of their staff and for the accuracy of the information they publish about their business, classes, and pricing.
3. Subscriptions, fees, and trials
- Studio subscriptions are billed in advance on the cycle shown on the pricing page (monthly, annually, etc.).
- Free trials renew automatically into the paid plan unless cancelled before the trial ends.
- Fees are non-refundable except where required by law or expressly stated in writing.
- You can cancel a studio subscription at any time from the admin panel. Cancellation takes effect at the end of the current billing period.
- We may change subscription pricing with at least 30 days’ notice; the new price applies from the next renewal.
4. Customer payments
When a customer pays for a class, package, or membership, the payment is processed by the studio’s chosen payment provider (Stripe, MercadoPago, PayPal, or similar). MotionHub does not store full card details. Refunds, chargebacks, and billing disputes for customer transactions are between the customer and the studio; MotionHub may assist but is not a party to those payments.
5. Acceptable use
You agree not to:
- use the Service for anything illegal or to infringe anyone’s rights;
- upload malware or attempt to interfere with the Service’s operation;
- reverse-engineer, scrape, or attempt to extract bulk data you are not entitled to;
- impersonate another person or studio;
- use the Service to send spam, harassment, or unsolicited marketing.
We may suspend or terminate accounts that violate these rules.
6. Your content
You retain ownership of the content you upload (logos, class descriptions, photos, documents, etc.). You grant MotionHub a worldwide, royalty-free licence to host, display, and process that content solely as needed to operate the Service for you. You are responsible for making sure you have the right to upload everything you post, and that it does not violate any third-party rights or applicable law.
7. AI assistant connections (MCP)
MotionHub can be connected to third-party AI assistants (Claude, ChatGPT, and similar) through our Model Context Protocol (MCP) integration. When you connect an assistant:
- The assistant authenticates to MotionHub through OAuth using your studio credentials and can only act within the permissions of your own user account.
- Write actions taken by the assistant (such as booking a class, cancelling a booking, or marking a no-show) are your actions and are governed by these Terms.
- Conversations you have with the assistant are governed by the assistant provider’s terms; MotionHub does not control or have access to those conversations.
- You can revoke an assistant’s access at any time from your account settings.
8. Service availability
We work to keep the Service available, but we do not guarantee uninterrupted operation. Planned maintenance, third-party outages, and unforeseen incidents may affect availability. We are not liable for losses arising from downtime, but we will tell you about planned maintenance in advance where possible.
9. Termination
You may stop using the Service at any time and close your account from the admin panel. We may suspend or terminate your access if you breach these Terms, if your account is required to be terminated by law, or if your account is inactive for an extended period. On termination, you remain liable for any fees already owed.
10. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
11. Limitation of liability
To the maximum extent permitted by law, MotionHub will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability for any claim arising out of or relating to the Service is limited to the fees you paid us in the twelve months preceding the event giving rise to the claim.
12. Indemnity
You agree to defend, indemnify, and hold MotionHub harmless from any claim, demand, or expense (including reasonable legal fees) arising out of your use of the Service, your content, or your violation of these Terms.
13. Changes to the Service or these Terms
We may modify the Service or these Terms from time to time. If a change is material, we will give at least 30 days’ notice by email or in-app banner. Continued use of the Service after the change takes effect constitutes acceptance of the new Terms. If you do not agree, you may stop using the Service.
14. Governing law
These Terms are governed by the laws of the jurisdiction in which Fexillon is established, without regard to its conflict-of-laws provisions. Disputes will be resolved in the competent courts of that jurisdiction, except where mandatory consumer-protection law gives you a different right.
